Huntsville Town’s subdivision rules sit in Title 15 (Land Use Regulations), Chapter 15.25.1, “Subdivision General Provisions”, which the town updated on December 5, 2024 after a November 21, 2024 Planning Commission hearing. Section 15.25.1.1 states the chapter’s purpose is “to comply with Utah Code §10-9a-604–609” and to make review “more administratively efficient.” This is a civic summary; the ordinance controls.
In 2023 the Utah Legislature passed S.B. 174, Local Land Use and Development Revisions. As enacted, it required cities to name an administrative land use authority, which may not be the city council or a council member, to review subdivision applications for single-family homes, two-family homes and townhomes, and it limited cities to four review cycles. State law has been amended since; the current text is in Utah Code Title 10, Chapter 20, Part 8 (the land use act was renumbered from Chapter 9a in 2025).
Who decides
Section 15.25.1.5 is explicit. Subsection A: “The Land Use Authority for preliminary subdivision applications is the Planning Commission,” which may delegate tasks to the Town Engineer, staff or an administrative hearing officer, and holds public hearings on preliminary applications “when the Planning Commission deems necessary.” Subsection B: “The Land Use Authority for final subdivision applications is the Planning Commission Chair,” who may delegate to staff and is responsible for signing approvals and ensuring recording.
Subsection C states that because subdivision decisions “are administrative, not legislative,” the land use authorities act “without Town Council approval,” and Subsection D bars the Town Council from directing an approval or denial except when sitting as appeal authority. Section 15.25.1.6 names the Huntsville Appeal and Variance Board as the appeal authority. Appeals go to the Town Clerk in writing within 30 days, and the board must decide within 30 days of a complete appeal.
The steps
- Pre-application meeting (optional). Under 15.25.1.9 a potential applicant may request a meeting with the Planning Commission, which staff must schedule within 15 business days for the next properly noticed meeting. The proposal “may be limited to a concept plan.”
- Preliminary application. Section 15.25.1.7 states the town “shall not approve, nor shall a party record, any plat” without both a preliminary and a final approval. Section 15.25.1.2 requires approval before a parcel is split into more parcels than were originally recorded.
- Notice to affected entities. Under 15.25.1.10, within 15 days of a complete application staff must notify the owner of any water-conveyance facility (canal, ditch or pipeline) within 100 feet, and the land use authority “shall not approve a subdivision application… sooner than 20 days after” the complete application is submitted.
- Review and approval. Sections 15.25.1.11 and 15.25.1.12 govern review deadlines and approval. The ordinance states the authority “shall approve any complete subdivision application… that complies with applicable Town ordinances and Utah State Code 10-9a-6,” and must issue approvals in writing and certify the plat.
- Final plat. Section 15.25.1.8 lists final plat requirements; the Planning Commission Chair is the deciding authority.
- Recording. Section 15.25.1.13 requires the applicant to record the approved plat with the Weber County Recorder “within 90 calendar days” after approval, and only after providing all required improvement guarantees under 15.25.1.16. An approved plat not recorded in time “is void, unless the Planning Commission approves an extension.”
Minor subdivisions. Section 15.25.1.14 exempts subdivisions of two or three parcels from the preliminary and final plat, improvement-plan and completion-assurance requirements when no public improvements are needed, the lots front an improved dedicated public street, no planned street or easement crosses the land, the water and sewer authorities have approved, and the land is zoned. Plat amendments follow 15.25.1.15, which defers to Utah Code 10-9a Part 6.
Where to find the agenda and how to comment
Planning Commission agendas are posted by year on the town’s Planning Commission agendas page and on the Utah Public Notice Website.
Because preliminary plat review is administrative, a hearing is held only when the Commission “deems necessary” (15.25.1.5). When a hearing is noticed, the notice on the Public Notice Website gives the date. Written comment can be sent to the Town Clerk, whose contact information is on the agenda.
What preliminary approval does and does not mean
Preliminary approval by the Planning Commission means the application was found complete and compliant at that stage. It is not a recorded plat and does not create lots; 15.25.1.7 requires a separate final approval, and 15.25.1.13 voids an approved plat that is not recorded within 90 days or whose improvements are not guaranteed. An agenda item is not a final approval, and any decision may be appealed to the Appeal and Variance Board within 30 days (15.25.1.6).
Timelines and fees
The ordinance sets the 15-business-day pre-application scheduling window, the 20-day water-conveyance waiting period, the 90-day recording deadline and the 30-day appeal windows noted above. The Huntsville Town Consolidated Fee Schedule passed September 4, 2025 lists:
| Application | Fee |
|---|---|
| Major Subdivision Application | $1,500 + applicable engineering fees + $25 per lot |
| Minor Subdivision Application | $750 + applicable engineering fees + $25 per lot |
The subdivision application form and the fee schedule are linked from the town’s land use forms and fee schedule page.
